My husband died 18 months ago. I had no clue as to how to secure my assets and home. I found Vitale law several time while looking for help getting my affairs in order so that when I pass my family would have access to all that I have. The very first meeting was very positive. I had them advise me on which to do? The revocable trust or irrevocable trust. After meeting we decided on both. That was the best decision I ever had made. I consulted my financial advisor as to was this the best for me? He advised yes. The cost was average for our area and the work they put into my business was incredibly accurate. I highly recommend getting their advice if you need to make up plans for your assets when left with a house and assets that would have gone into probate. They are absolutely 5 star attorneys! I had the first of 4 appointments (if I hired them) today. We had a very productive hour long session free of charge. I decided to go with them because they are military and second they don’t try to push you one way or another with the issues I have regarding protecting my estate when I pass. I opted for the full nine yards, both revocable and irrevocable trust accounts. Wha made me decide was the inclusion of the other trust would protect myself in case I end up in a senior care center the Medicare can’t go after my assets to pay for long term care. Also my lawyer Kevin was very knowledgeable about all the explanations and how each step will be done. Was a little more than I had planned to spend but once all is done I can rest in peace should something happen to me I know all my finances, house, distribution of wealth will be tied up so it will never go to probate. Was one of my worst fears. I’m very very happy to have them having my back. If you are wondering how to find a good firm that doesn’t overcharge you Vitale law firm is the ones to contact.Posted on Google![]()

Estate Planning
Estate planning is about more than deciding who receives your property. It gives you an opportunity to choose who can act for you during an emergency, provide for the people who depend on you, and create clear instructions for managing the assets you leave behind.
Vitale Law Firm helps individuals, families, retirees, and business owners in Merriam develop estate plans based on their individual needs. From our nearby Overland Park office, our attorneys serve clients throughout Merriam and Johnson County with practical guidance for planning ahead and protecting what matters most.
Having a will is a valuable starting point, but a will alone may not address every situation your family could encounter. A complete estate plan considers what happens to your property after death as well as who can make important decisions if you become unable to manage your own affairs.
Your plan may also need to account for assets that transfer through beneficiary designations or other ownership arrangements. When these pieces are created at different times without considering how they interact, the result may not reflect your current intentions.
Our attorneys help Merriam clients look at the entire picture so their documents, assets, and beneficiary decisions support the same overall goals.
The right estate planning strategy depends on your family, finances, property, health, and priorities. Some clients need foundational documents, while others have more complex concerns involving businesses, long-term care, special needs, or substantial assets.
Vitale Law Firm can assist with:
We explain how different options may apply to your circumstances so you can make informed decisions rather than simply signing documents you do not fully understand.
Your family structure can significantly influence your estate plan. Parents of young children may need to nominate guardians and establish how an inheritance should be managed until their children are older. Families with adult children may have different concerns involving grandchildren, property, or preserving assets for future generations.
Additional planning may be appropriate for blended families or when a beneficiary has disabilities or other circumstances that affect how an inheritance should be managed.
There is no single distribution strategy that is right for every household. Personalized planning gives you the ability to establish instructions that reflect your relationships and the responsibilities you want your plan to address.
An estate plan should also prepare for circumstances that happen during your lifetime. If an illness or injury prevents you from managing your finances or communicating healthcare decisions, someone may need the legal authority to act on your behalf.
Financial and healthcare powers of attorney allow you to choose trusted individuals for these responsibilities. Healthcare planning documents can provide additional guidance regarding your wishes.
Making these decisions while you are able to do so gives you greater control over who may step in during an emergency and can reduce uncertainty for family members.
Retirement can change both your financial circumstances and your estate planning priorities. You may begin drawing from retirement accounts, restructuring investments, transferring business responsibilities, or considering the possibility of future long-term care.
This can be a valuable time to review documents that may have been created many years earlier. Beneficiaries, powers of attorney, property ownership, and your goals for future generations may all have changed.
Vitale Law Firm can help evaluate your existing plan alongside current retirement and long-term care concerns to determine whether updates or additional strategies should be considered.
Probate is the court-supervised process used to administer certain estates after death. Probate matters involving Merriam residents are handled through the Johnson County District Court.
Whether property must go through probate depends on several factors, including how an asset is owned and whether a beneficiary or other transfer arrangement has been established. Trusts, beneficiary designations, and certain ownership structures may allow qualifying property to transfer outside probate.
Our Merriam estate planning attorneys can review these details as part of the planning process. Coordinating your legal documents with the way your assets are actually owned can help reduce unnecessary complications and create clearer instructions for your family.
Estate planning should provide clarity about the future. You should know what your documents accomplish, who has been given important responsibilities, and how your plan is intended to work when it is needed.
Vitale Law Firm provides personalized estate planning guidance to Merriam residents from our nearby Overland Park office. Whether you have never created an estate plan or have documents that need another look, our attorneys can help you develop a plan that reflects your current priorities and long-term goals.
I highly recommend Kevin and his team. As a fellow estate planning attorney, I’ve had the privilege of seeing firsthand the way he cares for his clients and approaches each matter with both skill and compassion. Kevin takes the time to truly listen, explain complex issues in a clear and approachable way, and craft plans that reflect not only his clients’ legal needs but also their personal values and family goals.
What sets Kevin apart is his ability to combine deep knowledge with genuine kindness. He makes sure families feel heard, understood, and protected. Clients working with him can trust that they are in capable hands and that their futures are being planned with precision and care.

Here are answers to some of the most common questions we hear about estate planning in Kansas
Common problems can include having outdated documents, failing to coordinate beneficiary designations with the rest of an estate plan, or overlooking planning for incapacity. Another potential issue is creating a trust without properly addressing which assets should be connected to it. Periodic reviews can help identify gaps before they become problems for you or your family.
If you are unable to manage your affairs and have not provided appropriate legal authority to someone else, your family may have fewer options for handling certain financial or personal matters on your behalf. A properly prepared power of attorney can designate someone you trust to act under the circumstances described in the document.
Real estate can potentially be transferred into a revocable living trust as part of an estate planning strategy. Whether doing so makes sense depends on your property, ownership arrangements, and overall goals. An estate planning attorney can explain how transferring real estate into a trust would fit within your broader plan.
The result depends on your documents and how they address that situation. An estate plan can include instructions for what should happen if a beneficiary dies before you, but older documents may not reflect what you currently want. The death of a beneficiary is an important reason to review an existing plan.
Start by reviewing when and where your documents were prepared and what has changed since then. Changes involving your family, assets, residence, beneficiaries, or the people selected for important roles may affect whether the plan still reflects your wishes. If your documents were prepared in another state or many years ago, a Kansas estate planning attorney can review them and discuss whether updates are appropriate.
