My husband died 18 months ago. I had no clue as to how to secure my assets and home. I found Vitale law several time while looking for help getting my affairs in order so that when I pass my family would have access to all that I have. The very first meeting was very positive. I had them advise me on which to do? The revocable trust or irrevocable trust. After meeting we decided on both. That was the best decision I ever had made. I consulted my financial advisor as to was this the best for me? He advised yes. The cost was average for our area and the work they put into my business was incredibly accurate. I highly recommend getting their advice if you need to make up plans for your assets when left with a house and assets that would have gone into probate. They are absolutely 5 star attorneys! I had the first of 4 appointments (if I hired them) today. We had a very productive hour long session free of charge. I decided to go with them because they are military and second they don’t try to push you one way or another with the issues I have regarding protecting my estate when I pass. I opted for the full nine yards, both revocable and irrevocable trust accounts. Wha made me decide was the inclusion of the other trust would protect myself in case I end up in a senior care center the Medicare can’t go after my assets to pay for long term care. Also my lawyer Kevin was very knowledgeable about all the explanations and how each step will be done. Was a little more than I had planned to spend but once all is done I can rest in peace should something happen to me I know all my finances, house, distribution of wealth will be tied up so it will never go to probate. Was one of my worst fears. I’m very very happy to have them having my back. If you are wondering how to find a good firm that doesn’t overcharge you Vitale law firm is the ones to contact.Posted on Google![]()

Asset Protection
Your home, your business, your financial security, and the future you’re planning for your family didn’t happen by accident. They took work, sacrifice, and long-term dedication. Protecting those achievements requires the same level of intentional strategy.
Our firm helps individuals and families in Kansas City and surrounding communities put legal safeguards in place that reduce risk, prevent unnecessary losses, and keep control firmly in their hands. Whether you’re a business owner facing potential liability, a parent planning ahead for your children, or a retiree wanting to secure assets from long-term care costs, we help you build a structure that protects what matters most.
Asset protection isn’t about hiding what you own, it’s about planning wisely so that your hard-earned achievements aren’t undone by conflict, crisis, or unexpected events.
Life is unpredictable, and the legal consequences of that unpredictability can be serious. Without a protective plan in place, the wealth and stability you’ve created could be vulnerable to real-world risks, including:
Lawsuits and Judgments: If someone takes legal action against you or your business, your personal property and savings may be exposed unless clear boundaries exist.
Long-Term Care Expenses: Nursing home costs are one of the greatest threats to a family’s financial future. Without planning, you may be forced to spend down assets or risk Medicaid penalties.
Family Disputes: When assets aren’t clearly structured or protected, disagreements among relatives can escalate into expensive legal battles.
Probate Delays and Costs: Without proactive planning, your assets may be tied up in probate, causing unnecessary stress and uncertainty for your family.
Unintended Distributions: If your wishes aren’t documented and protected, state law, not your personal intentions, will determine the outcome.
With purposeful planning, you direct the outcome. You decide how your property is managed, preserved, and passed on, not the court system.
Every client’s situation is unique. We take the time to understand your goals, identify risks, and design a plan that supports your long-term security. Asset protection isn’t just about legal documents; it’s about creating a system that works when life takes an unexpected turn.
Trusts are among the most effective tools for shielding assets. We help clients create:
Revocable living trusts to streamline estate management and avoid probate
Irrevocable asset protection trusts for clients with higher exposure or long-term care concerns
We guide you through every step of funding, maintaining, and updating your trust. A trust only works if it’s properly executed—we ensure yours does.
If you operate a business in Kansas, your personal assets could be at risk without the right structure in place. We help business owners:
Form and maintain entities such as LLCs and S-corporations
Develop operating agreements that define ownership, decision-making, and exits
Separate personal and business liability
Incorporate succession planning for long-term stability
This isn’t simply paperwork—it’s the foundation that protects your livelihood and financial future.
The cost of long-term care can quickly consume a lifetime of savings. Early legal planning can help you:
Structure assets within Medicaid guidelines
Utilize irrevocable trusts and timing strategies
Create caregiver contracts and compliant spend-down plans
ut powers of attorney and medical directives in place
Planning ahead can protect your home, preserve your savings, and ensure you receive needed care without sacrificing everything you’ve built.

Here are answers to some of the most common questions we hear about asset protection in Kansas
Asset protection involves using legal tools—such as trusts, business entities, and exemption planning—to shield your property from lawsuits, creditors, long-term care costs, and probate disputes. The goal is to keep control of your assets and reduce financial risk.
Not everyone needs a trust, but many people benefit from one. Revocable trusts help with probate avoidance, while irrevocable trusts can offer protection from creditors and Medicaid spend-down rules. An attorney can help determine which type fits your goals.
Strategies may include Medicaid planning, irrevocable trusts, proper asset titling, and early legal preparation. Planning in advance allows you to qualify for care without losing your home or draining your retirement savings.
Forming the right business entity—such as an LLC or corporation—can separate business and personal assets. Operating agreements, liability insurance, and proper maintenance of company records also strengthen protection.
The best time to start is before a problem arises. Once you’re facing a lawsuit, debt, or long-term care crisis, your options may be limited. Planning early gives you more tools and stronger legal protections.

We start with a focused conversation to understand your goals, challenges, and priorities. This isn’t just a quick intake, it’s where we listen closely, answer your questions, and outline your options with clarity.
